Commenting on the provisional political agreement reached today by EU negotiators on the Platform Work Directive, BDA Managing Director Steffen Kampeter said:
Employment status must be determined in accordance with national law
Berlin, February 8, 2024: "The platform economy can be an important growth driver for the future. Using EU regulation to specify when self-employed people are in dependent employment is and remains problematic. We already have suitable procedures in Germany to correctly determine the status of platform workers. Germany's planned abstention in the Council therefore remains correct. At the same time, the compromise reached today ensures that the determination of status is carried out in accordance with the different national circumstances and free of EU criteria. This is the crucial point in order to guarantee a practicable implementation of the directive in Germany, which does not unintentionally force the self-employed into an employment relationship."
