The BDA comments on today's Opinion of the Advocate General before the ECJ on the EU Minimum Wage Directive:
Cancellation would be the right step
Berlin, January 14, 2025: "The Advocate General's Opinion on the Minimum Wage Directive cannot be surpassed in terms of clarity. They prove it: Employers' doubts about the Minimum Wage Directive were always well-founded.
With regard to the Minimum Wage Directive, we have always warned against a breach of the European Treaties. The EU has no competence in the area of wages and collective bargaining autonomy. The German government's argument was on shaky ground from the outset.
The annulment proposed by the Advocate General would be the right step. We are now waiting for the ruling and hope that the judges will follow the Advocate General."
